Notification of construction – with surveyor’s assistance

Notification of construction [1] is a document that immediately before the start of construction work must be reported to the local municipality.

As can be seen from the above, a Construction Permit Decision is not always necessary.

In 2019, regulations came into force amending the Construction Law Art. 30 [2], which introduced the possibility of construction under a simplified procedure of free-standing, no more than two-story single-family residential buildings with a construction area of up to 70 m2, the impact area of which is entirely within the plot.  An additional aspect of this Law is that there is no obligation to hire a construction manager or keep a construction log.[3]

The construction notification also applies to structures such as:

  1. free-standing one-story outbuildings, garages, sheds or backyard porches and orangeries (conservatories), gazebos with a construction area of up to 35 m², with the total number of these objects on the plot not exceeding two for each 500 m² of the plot;
  2. domestic sewage treatment plants with a capacity of up to 7.50 m³ per day;
  3. Non-drainage tanks for liquid waste with a capacity of up to 10 m³;
  4. above-ground terraces with a construction area of more than 35m2
  5. charging stations
  6. connections
  7. school playing fields, tennis courts, running tracks used for recreation
  8. outbuildings related to agricultural production, complementing homestead development within an existing habitat plot:
  • slabs for manure storage,
  • sealed slurry or manure tanks,
  • above-ground silos for bulk materials, with a capacity of up to 250 m3 and a height of no more than 15 m,
  • silos for silage

How and where do we submit construction applications?

Applications are submitted to the office of the municipality where the property covered by the construction project is located, by mail or electronically via the e-building portal. [4]

An application for the construction of a single-family house is required to be accompanied by relevant statements such as a: statement of assumption of responsibility for directing the construction, a statement that the documents are complete, and a statement that the investment is for one’s own residential needs. The application must specify the type, scope, place and manner of construction work, as well as the date on which it is to begin. In addition, other documents may be required depending on the work envisaged and the requirements of the municipality.

The construction notification must be submitted min. 21 days before starting construction work. Unlike a building permit, you do not have to wait for approval from the relevant authority. If within 21 days from the date of delivery of the notification the district or municipal office does not object, construction can begin.

Participation and assistance of a surveyor in the field of construction

  1. Height measurement of the land, land leveling. Leveling means taking measurements on the ground to determine the difference in height.
  2. updating the base map when creating a map for design purposes(link to Philip’s blog)-if it will be necessary to develop a plot or land development project
  3. as-built inventory to wchich they are subject:
  • free-standing buildings up to 35m2 and above 35m2 up to 70m2 with a span of structural elements up to 6 meters
  • connections: electricity, water, sewage, gas, heat, telecommunications
  • charging stations

As-built documentation constitutes evidence of the result of completed and completed construction works. [5]
